What Is Division 293 Tax?

Division 293 is an additional 15% tax on concessional (before-tax) superannuation contributions for individuals whose income plus contributions exceeds $250,000 in a financial year. Combined with the standard 15% contributions tax, this brings the total tax on caught contributions to 30% โ€” still well below the 47% top personal marginal rate (including Medicare levy).

The Formula

Division 293 Income = Taxable Income + Reportable Fringe Benefits
+ Net Investment/Rental Losses (added back) + other adjustments

Excess = (Division 293 Income + Concessional Contributions) โˆ’ $250,000
Taxable Contributions = LESSER of (Concessional Contributions) or (Excess)
Tax = Taxable Contributions ร— 15%

The "lesser of" rule matters โ€” you're never taxed on more than your actual contributions, even if your income excess is larger.

How to Use This Calculator

Enter your taxable income, any reportable fringe benefits, and net investment or rental losses (these get added back for Division 293 purposes, even though they reduced your taxable income). Add your concessional super contributions for the year โ€” employer Super Guarantee, salary sacrifice, and personal deductible contributions all count.

The Threshold Hasn't Moved Since 2017

The Division 293 threshold was reduced from $300,000 to $250,000 effective 1 July 2017 and has remained unchanged since โ€” meaning more people get caught by it each year as wages grow with inflation, even without any change to the rule itself.

One-Off Events Can Trigger It Unexpectedly

  • Selling an investment property or shares (capital gains)
  • Receiving a redundancy or termination payment
  • An unusually large bonus

Any of these can push someone who normally earns well under $250,000 over the threshold for that single year โ€” Division 293 is assessed year by year, not as a permanent status.

๐Ÿ’ก If you're approaching $250,000 due to a one-off event, you may receive an unexpected Division 293 notice in your myGov inbox a few weeks after lodging your tax return โ€” it's a separate assessment from your regular tax return.

Super Is Still Worth It

Even at the full 30% combined tax rate, concessional super contributions still deliver a meaningful saving compared to the 47% top marginal personal tax rate โ€” a 17 percentage point gap that compounds significantly over a career, even after Division 293 applies.

How You Pay It

Division 293 tax is assessed separately from your regular tax return, with its own notice typically arriving 2โ€“4 weeks after your main assessment. You can pay it personally (due 21 days from the notice) or elect to release the amount from your super fund (60-day deadline) โ€” most people choose the release option since the money was already taxed at the concessional 15% rate going in.

Frequently Asked Questions

What is the Division 293 income threshold?
$250,000, unchanged since being reduced from $300,000 on 1 July 2017.
Is Division 293 the same as Division 296?
No โ€” Division 293 taxes concessional contributions for high-income earners over $250,000. Division 296 separately taxes superannuation earnings for those with total super balances over $3 million. They can both apply to the same person.
Can Division 293 apply to me even if I don't normally earn $250,000?
Yes โ€” a one-off capital gain, redundancy payment, or large bonus can push your income over the threshold for that single year, even if your typical income is well below it.
How do I pay Division 293 tax?
You can pay personally within 21 days of the notice, or elect to release the amount from your super fund within 60 days โ€” most people choose the super release option.
Does Division 293 apply to excess concessional contributions?
No โ€” contributions above your concessional cap are excluded from Division 293 and instead taxed at your marginal rate with a 15% offset for tax already paid in the fund.
Is super still worth it if I'm caught by Division 293?
Generally yes โ€” even the full 30% combined tax rate remains well below the 47% top marginal personal rate, so the tax advantage of super contributions is reduced but not eliminated.
Do defined benefit fund members get assessed differently?
Yes โ€” Division 293 on defined benefit contributions is generally deferred until a benefit is actually paid, recorded as a debt against the member's account in the meantime.
Will the $250,000 threshold ever increase?
It's not indexed and has been static since 2017 โ€” any change would require new legislation, unlike the Division 296 thresholds which are CPI-indexed.
